CALIFORNIA CONSUMER PRIVACY ACT
This law was passed in 2018 and effective on January 1, 2020. It provides additional privacy rights to California residents, and businesses that meet certain criteria are required to comply with this Act.
Use this form to add into your Privacy Policy if it is applicable to your business. You can add it as a separate section into your template. This is a basic add-on, if your business does need to comply with the CCPA, you should consider contacting an attorney to help ensure that not only does your privacy policy comply with the CCPA but your business practices and policies also comply.
The CCPA applies to you if:
You do business in California (offer goods/services to people in CA);
You collect personal information from California residents;
You make decisions on how that data is collected, used, or shared; AND
One of the these three conditions:
Annual gross revenue is over $25 million;
You collect, buy, or share data from over 50,000 California residents per year; OR
You make 50% or more of your annual revenue through selling personal information.
As you read through the template add-on below, you will notice that the additional rights that consumers have requires action on your part as well.
This differs from the GDPR because the additional rights that EEA residents have are afforded to them at their request (they opt in or request it), but the CCPA is more of an opt-out mechanism. Businesses are required to disclose to consumers any personal information that is collected and the purpose it is used for.
This might require a business to keep records of consumer requests as well as consumer information. However, it does not require businesses to retain personal information that was collected for a single purpose and was not sold or retained by you.
Businesses should have a clear “Do Not Sell My Personal Information” link visible on the home page for California consumers to opt-out.
Requests under the CCPA should be complied with in 45 days.
California Consumer Privacy Act:
If you are a California resident, you are afforded certain additional rights:
*You have the right to know whether personal information is being collected about you, what that information is, and the purpose for that collection.
*You have the right to request the specific categories of information collected about you.
*You have the right to “say no” to the sale of personal information by opting out without any detrimental impact against you for exercising this right.
*You have the right to request the deletion of your personal data.
*You have the right to equal service and price, regardless of making any requests under these additional privacy rights.
